DISABILITY ACT 2006 - SECT 251

Supervised treatment orders

    (1)     If a supervised treatment order is in force immediately before the commencement day, on and from the commencement day the disability service provider or registered NDIS provider that appointed the Authorised Program Officer stated in the order as being responsible for the implementation of the order is taken to be the primary service provider for the person in respect of whom that application was made.

    (2)     Subject to subsection (3), on and from the commencement day, this Act as amended by the Disability and Social Services Regulation Amendment Act 2023 applies to a supervised treatment order or an interim supervised treatment order that is in force immediately before the commencement day.

    (3)     A supervised treatment order made in respect of a person before the commencement day continues in force until the order expires or is revoked.
