DISABILITY ACT 2006 - SECT 41

Registration

    (1)     The Secretary may register a person or an unincorporated body as a disability service provider if the Secretary is satisfied that—

        (a)     the person or unincorporated body can provide a service for persons with a disability; and

        (b)     the service can be provided in compliance with the requirements of this Act.

    (2)     The Secretary may impose at any time any conditions or restrictions that the Secretary considers appropriate on the registration of a disability service provider and may vary at any time any condition or restriction so imposed or impose a new condition or restriction.

    (3)     Without limiting the generality of subsection (2), the Secretary may impose conditions with respect to staffing arrangements and the appointment, numbers and qualifications of persons to be employed or engaged by the disability service provider in the provision of disability services.

    (4)     Unless revoked, the registration of a disability service provider has effect for a period of 3 years or a longer period as determined by the Secretary in each case.
