DRUGS, POISONS AND CONTROLLED SUBSTANCES ACT 1981 - SECT 60F

Search of person irrespective of age without warrant

S. 60F(1) amended by No. 37/2014 s. 10(Sch. item 47.8(a)).

    (1)     Subject to sections 60G and 60H, a police officer, without warrant, may search a person and any vehicle, package or thing in that person's possession or under his or her control for a volatile substance or an item used to inhale a volatile substance if the police officer has reasonable grounds for suspecting that the person intends to provide—

        (a)     a volatile substance to a person under 18 years of age to inhale; or

        (b)     an item to a person under 18 years of age to use to inhale a volatile substance.

    (2)     A police officer may search a person under subsection (1) irrespective of the age of the person.
