DRUGS, POISONS AND CONTROLLED SUBSTANCES ACT 1981 - SECT 65

Determination of applications

S. 65(1) amended by No. 22/2022 s. 60(1).

    (1)     Subject to section 63A, after considering an application and any investigation under section 63, the Secretary must determine an application by—

        (a)     issuing an authority; or

        (b)     refusing to issue an authority.

S. 65(2) amended by No. 22/2022 s. 60(2).

    (2)     The Secretary must notify the applicant in writing of the decision under subsection (1) within 21 days of making the decision.

    (3)     If the decision is to refuse to issue the authority, the Secretary must—

        (a)     notify the Chief Commissioner of Police that the Secretary has refused to issue the authority; and

        (b)     subject to section 69AC(2), provide reasons for that decision to the applicant; and

        (c)     inform the applicant that they have the right to seek review of the Secretary's decision by VCAT.
