ESSENTIAL SERVICES COMMISSION ACT 2001 - SECT 60A

Contraventions of this Act and relevant legislation by bodies corporate

S. 60A(1) amended by No. 12/2023 s. 12.

    (1)     If a body corporate contravenes a civil penalty requirement or commits an offence against any provision of this Act or relevant legislation (other than an offence against the Victorian Energy Efficiency Target Act 2007 ), each officer of the body corporate is taken to have contravened the same civil penalty requirement or provision if the officer knowingly authorised or permitted the contravention.

    (2)     A person may be proceeded against (and, in the case of an offence, convicted) under a provision in accordance with subsection (1) whether or not the body corporate has been proceeded against under that provision.

    (3)     Nothing in this section affects any liability imposed on a body corporate for a contravention of a civil penalty requirement or a provision of this Act or relevant legislation by the body corporate.
