ESSENTIAL SERVICES COMMISSION ACT 2001 - SECT 62C

Court may grant relief from liability

    (1)     If in a proceeding specified in subsection (2), in which a person, other than a body corporate, may be liable for an offence or a civil penalty, it appears to the court that the person acted honestly and reasonably and, having regard to all the circumstances of the case, ought fairly to be excused, the court may relieve the person either wholly or partly from liability on such terms as the court thinks fit.

    (2)     For the purposes of subsection (1) the following proceedings are specified—

        (a)     a proceeding for the commission of an offence against any provision of this Act or relevant legislation in respect of which the Commission has powers or functions;

        (b)     a proceeding for the contravention of a civil penalty requirement.
