FIRST HOME OWNER GRANT AND HOME BUYER SCHEMES ACT 2000 - SECT 23

Power to correct decision

    (1)     If the Commissioner decides an application and is later satisfied (independently of an objection under this Act) that the decision is incorrect, the Commissioner may vary or reverse the decision.

    (2)     A decision cannot be varied or reversed under this section more than 5 years after it was made unless, at the time the decision was made, all the facts and circumstances affecting whether a first home owner grant was payable to the applicant in respect of whom the decision was made were not fully and truly disclosed to the Commissioner.
