FINES REFORM ACT 2014 - SECT 168

Determination of rehearing

    (1)     On rehearing a matter under section 167, if the Magistrates' Court is satisfied, on the balance of probabilities, that a ground referred to in section 167(3) has been established the Magistrates' Court may—

S. 168(1)(a) amended by No. 29/2016 s. 41(3)(a).

        (a)     cancel the order made under section 165(3)(e); and

S. 168(1)(b) amended by No. 59/2017 s. 46(a).

        (b)     exercise any power available to the Magistrates' Court under section 165 in respect of the person in default.

    (2)     If the Magistrates' Court is not satisfied that a ground referred to in section 167(3) has been established, the Magistrates' Court—

S. 168(2)(a) amended by Nos 29/2016 s. 41(3)(a), 59/2017 s. 46(b).

        (a)     must confirm the order to imprison the person in default under section 165(3)(e); and

        (b)     may—

S. 168(2)(b)(i) amended by Nos 29/2016 s. 41(3)(b), 59/2017 s. 46(c).

              (i)     issue a warrant to imprison the person in default under section 165A(2)(a) if the person in default is not in custody; and

S. 168(2)(b)(ii) amended by Nos 29/2016 s. 41(3)(c), 59/2017 s. 46(c).

              (ii)     lift a stay on an instalment order (if any) made in respect of the person in default under section 165A(2)(b).

    (3)     Subject to section 167(4), the Magistrates' Court may only rehear a matter once.
