MAGISTRATES' COURT ACT 1989 - SECT 17

Employment of principal registrar, registrars and deputy registrars

S. 17(1) amended by Nos 46/1998 s. 7(Sch. 1), 108/2004 s. 117(1) (Sch.  3 item 118.2).

    (1)     For the purposes of this Act and to assist in the administration of the Court there are to be employed under Part 3 of the Public Administration Act 2004

        (a)     a principal registrar; and

        (b)     as many registrars and deputy registrars as are necessary.

    (2)     The principal registrar, registrars and deputy registrars have the duties, powers and functions provided by this Act and the Fines Reform Act 2014 , the regulations and the Rules.

    (3)     The principal registrar may, by instrument, delegate to any registrar or class of registrars any function or power of the principal registrar under this Act and the Fines Reform Act 2014 , the regulations or the Rules, except this power of delegation.

    (4)     A deputy registrar may, subject to this Act, the regulations and the Rules and to any directions of a registrar, exercise any of the powers or perform any of the functions of a registrar.
