MENTAL HEALTH AND WELLBEING ACT 2022 - SECT 34

Designated mental health service must take reasonable steps

    (1)     A designated mental health service must take all reasonable steps to support a nominated support person to perform their role under this Act.

    (2)     Without limiting subsection (1), and subject to this Act, steps a designated mental health service may take include the following—

        (a)     allowing the nominated support person to view documents relevant to the patient's care and treatment at the service including—

              (i)     the patient's treatment plan; and

              (ii)     any known advance statement of preferences; and

        (b)     providing the nominated support person with information about the patient's care and treatment at the service; and

        (c)     providing the nominated support person with reasonable opportunities to attend any meetings between the patient and the persons responsible for their treatment.
