(1) On receiving an application under section 240, Safe Transport Victoria must register the person as a pilotage services provider if Safe Transport Victoria is satisfied that the person has the competence and capacity to carry out pilotage services safely.

(2) For the purposes of subsection (1), Safe Transport Victoria must have regard to whether the person meets or satisfies the prescribed requirements (if any).
