MARINE SAFETY ACT 2010 - SECT 37

Offence if recreational vessel not registered

S. 37(1) amended by No. 36/2013 s. 41(2).

    (1)     An owner of a recreational vessel must not cause or allow the vessel to be operated on State waters unless that vessel is—

        (a)     registered under this Part; or

        (b)     exempted from registration—

              (i)     by the regulations; or

S. 37(1)(b)(ii) amended by No. 34/2023 s. 127(Sch.  1 item 7.6).

              (ii)     by a notice given by Safe Transport Victoria under section 260.

Penalty:     60 penalty units.

    (2)         A master of a recreational vessel must not     operate a recreational vessel on State waters unless that vessel

        (a)     is registered under this Part; or

        (b)     exempted from registration—

              (i)     by the regulations; or

S. 37(2)(b)(ii) amended by No. 34/2023 s. 127(Sch.  1 item 7.6).

              (ii)     by a notice given by Safe Transport Victoria under section 260.

Penalty:     60 penalty units.

    (3)     A person must not, being the owner or master of a recreational vessel

        (a)     cause or allow the vessel to be operated in breach of any condition of its registration; or

        (b)     employ or engage a person to operate the vessel in breach of any condition of its registration.
