PUBLIC INTEREST DISCLOSURES ACT 2012 - SECT 77

Immunity of the IBAC and Integrity Oversight Victoria and officers

S. 77(1) amended by No. 31/2024 s. 113(Sch.  1 item 28.51).

    (1)     The IBAC, an IBAC Officer, Integrity Oversight Victoria or an Integrity Oversight Victoria Officer is not personally liable for anything necessarily or reasonably done or omitted to be done in good faith—

        (a)     in the performance of a duty or a function or the exercise of a power under this Act or the regulations made under this Act; or

        (b)     in the reasonable belief that the act or omission was in the performance of a duty or a function or the exercise of a power under this Act or the regulations made under this Act.

    (2)     Any liability resulting from an act or omission that would, but for subsection (1), attach to the IBAC, an IBAC Officer, Integrity Oversight Victoria or an Integrity Oversight Victoria Officer attaches instead to the State.
