ROAD SAFETY ACT 1986 - SECT 16D

Register of written-off vehicles

S. 16D(1) substituted by No. 55/2013 s. 17, amended by No. 49/2019 s. 116(Sch.  1 item 25(a)).

    (1)     The Secretary must maintain a register of written-off vehicles that—

        (a)     includes vehicles of the class or classes prescribed by the regulations; and

        (b)     is kept in the manner prescribed by the regulations.

    (2)     Entries on the register of written-off vehicles may be made, amended and removed only in accordance with the regulations.

    (2A)     In entering a vehicle on the register of written-off vehicles, the Secretary

        (a)     is entitled to rely on a determination made by an insurer or self-insurer under section 16C(1)(b) that a written-off vehicle is a statutory write-off or a repairable write-off; and

        (b)     is not required to make any enquiries in relation to the matter before entering the vehicle on the register.

    (4)     If—

        (a)     a vehicle is entered on the register of written‑off vehicles as a repairable write-off; and

S. 16D(4)(b) amended by Nos 37/2014 s. 10(Sch. item 147.6), 49/2019 s. 116(Sch.  1 item 25(c)(i)).

        (b)     a police officer authorised by the Chief Commissioner of Police for the purposes of this subsection notifies the Secretary in writing that the entry of the vehicle on the register should be as a statutory write-off

the Secretary must amend the entry accordingly.
