RESIDENTIAL TENANCIES ACT 1997 - SECT 498LA

Restriction on use of personal information provided by applicants for SDA dwellings

An SDA provider or that person's agent must not use personal information disclosed by a person on an application form used to apply to enter into an SDA residency agreement unless the use is for the following—

        (a)     to determine whether the applicant is, or will be, an SDA resident;

        (b)     to determine whether the SDA dwelling meets the needs of the applicant;

S. 498LA(c) amended by No. 9/2023 s. 169(2).

        (c)     if the SDA dwelling is a shared living environment, to assess the applicant's compatibility with—

S. 498LA(c)(i) amended by No. 9/2023 s. 169(2).

              (i)     SDA residents already residing in the SDA dwelling; or

S. 498LA(c)(ii) amended by No. 9/2023 s. 169(2).

              (ii)     other applicants applying to enter into an SDA residency agreement in respect of the SDA dwelling.
