RESIDENTIAL TENANCIES ACT 1997 - SECT 498ZZZC

Disposal of certain goods left behind

S. 498ZZZC(1) amended by No. 9/2023 s. 216.

    (1)     If goods have been left behind, the SDA dwelling owner may remove and destroy or dispose of the goods if—

        (a)     the goods are of no monetary value; or

        (b)     the goods are perishable foodstuffs; or

        (c)     the goods are dangerous.

    (2)     Despite subsection (1)(a), the SDA dwelling owner must not remove and destroy or dispose of goods that have been left behind if those goods are prescribed goods.

    (4)     Nothing in this section affects the operation of any other Act or law affecting the removal, destruction or disposal of goods.

Note

Other legislation of the State and Commonwealth may deal with the disposal of goods for example, the  Dangerous Goods Act 1985 .
