SENTENCING ACT 1991 - SECT 16A

Person may consent to imprisonment in respect of unpaid fines

S. 16A(1) amended by Nos 32/2013 s. 56(1), 47/2014 s. 305(2), 17/2022 s. 82.

    (1)     A person who has one or more warrants issued against them under section 69, and who is already in custody serving an uncompleted sentence of imprisonment may request, in writing, the sheriff to apply to the court for an order for that person to serve a period of imprisonment in default of payment of the outstanding fine or any instalment under an instalment order under any one or more warrants.

    (2)     The Court may order that the person be imprisoned in accordance with section 16(2) for a term calculated in accordance with section 69N.

    (3)     If the Court makes an order under subsection (2), the Court may count the time served by the person from the date the person requested the sheriff to make an application under subsection (1) as time already served for the purposes of the term of imprisonment imposed on the person under subsection (2).

    (4)     A court may make an order under subsection (2) whether or not the person is brought before the court.
