(1) The Chief Investigator, Transport Safety is to be appointed by the Governor in Council for a period of up to 5 years.

(2) The Chief Investigator, Transport Safety is to hold office on the terms and conditions (including remuneration and allowances) set out in the instrument by which the Chief Investigator, Transport Safety was appointed.

(4) The Governor in Council may only appoint a person to the office of the Chief Investigator, Transport Safety if, in the opinion of the Governor in Council, the person has at least 2 of the following attributes—

(5) The Public Administration Act 2004 (other than Part 3 of that Act) applies to the Chief Investigator, Transport Safety in respect of the office of the Chief Investigator, Transport Safety.
