WATER ACT 1989 - SECT 145

Control over connections[26]

S. 145(1) substituted by No. 23/2019 s. 59(1).

    (1)     For the purpose of section 145A, an Authority may consent to—

        (a)     the connection of any works to the works of the Authority; or

        (b)     the alteration or removal of any works that are connected to the works of the Authority; or

        (c)     the discharge of anything into the works of the Authority.

    (2)     An application for the Authority's consent must be made in a manner determined by the Authority and must be accompanied by—

        (a)     any fee fixed by a determination of the Authority under subsection (3C); and

        (b)     any plan that the Authority requires; and

        (c)     any other information that the Authority requires.

    (3)     The Authority may—

        (a)     refuse its consent; or

        (b)     consent; or

        (c)     consent subject to any terms and conditions it thinks fit.

    (3AA)     For the purposes of subsection (3)(c), a condition may be that—

        (a)     a separate meter is installed—

              (i)     for each occupancy on the land on which the works to be connected will be situated; or

              (ii)     if water is delivered, or proposed to be delivered, for more than one type of service in the exercise of the Authority's water supply or delivery functions, to measure the amount of water delivered for each service; or

        (b)     each meter that is installed on that land is positioned as the Authority considers appropriate.

    (3A)     A person may apply to VCAT for review of a decision by an Authority under subsection (3).

S. 145(3B) inserted by No. 17/2012 s. 25.

    (3B)     An application for review under subsection (3A) must be lodged with VCAT within 28 days after—

        (a)     notice of the decision was given; or

        (b)     if, under section 45 of the Victorian Civil and Administrative Tribunal Act 1998 , the person requests a statement of reasons for the decision, the day on which the statement of reasons is given to the person or the person is informed under section 46(5) of that Act that a statement of reasons will not be given.

    (3C)     An Authority may make a determination for or   with respect to the fee to accompany an application for the Authority's consent under this   section.

    (4)     A person who causes or permits anything referred to in section 145A(3) or (6) to be done must make sure that it is done in accordance with any terms or conditions subject to which the Authority gave its consent.

Penalty:     For an individual, 60 penalty units;

For a body corporate, 300 penalty units.

Note

Section 297 applies to an offence against this subsection.

    (5)     Terms and conditions subject to which the Authority consents are binding on the successors in title of the person who applied for that consent.
