Victorian Current Acts Victorian Current ActsWhere the worker has obtained a judgment in any proceedings to recover damages against the employer or a third party and judgment remains unsatisfied in whole or in part the worker shall be entitled to claim compensation under this Act but not for an amount greater than the amount by which such judgment remains unsatisfied, any moneys so recovered by way of compensation shall for the purposes of such judgment be deemed to be moneys recovered under such judgment and the amount owing thereunder shall be reduced accordingly.
