WORKPLACE INJURY REHABILITATION AND COMPENSATION ACT 2013 - SECT 296

Outcome certificates to be issued

S. 296(1) amended by No. 73/2016 s. 21(2).

    (1)     Subject to subsection (4), ACCS must issue an outcome certificate within 7 days of the conclusion of a conciliation if—

S. 296(1)(a) amended by No. 15/2021 s. 30.

        (a)     the dispute that is the subject of the conciliation was lodged for conciliation under section 289A; and

        (b)     the dispute is resolved.

    (2)     The outcome certificate must—

S. 296(2)(a) amended by No. 73/2016 s. 21(1).

        (a)     be in a form approved by ACCS; and

        (b)     be provided to the worker and the employer and the Authority or self-insurer; and

        (c)     set out any terms on which the dispute is resolved; and

        (d)     certify that each party to the dispute is bound by the result; and

        (e)     state that the outcome certificate is evidence of—

              (i)     the resolution of the dispute between the parties; and

              (ii)     the terms on which the dispute has been resolved.

    (3)     The outcome certificate is admissible in any court proceeding as evidence of—

        (a)     the resolution of the dispute between the parties; and

        (b)     the terms on which the dispute has been resolved.

    (4)     ACCS is not required to comply with subsection (1) in relation to a dispute referred to in that subsection if ACCS issues a certificate in respect of that dispute under section 273 of this Act or section 104(7) of the Accident Compensation Act 1985 .
