WITNESS PROTECTION ACT 1991 - SECT 9E

Cessation of interim protection declaration

    (1)     An interim protection declaration that is in force in accordance with section 9D ceases to be in force if the Chief Commissioner

S. 9E(1)(a) amended by No. 34/2016 s. 10(1)(a).

        (a)     enters into a memorandum of understanding with the witness in accordance with section 5 or  9R; or

S. 9E(1)(b) amended by No. 34/2016 s. 10(1)(b).

        (b)     notifies the witness of the Chief Commissioner's decision not to provide alternative protection arrangements to the witness; or

S. 9E(1)(c) inserted by No. 34/2016 s. 10(1)(c).

        (c)     receives a request in writing from the witness that the interim protection cease.

    (2)     The Chief Commissioner must notify a witness to whom an interim protection declaration relates of—

        (a)     the Chief Commissioner's decision not to include the witness in the Victorian witness protection program; or

        (b)     the Chief Commissioner's decision not to provide alternative protection arrangements to the witness.
