Victorian Consolidated Regulations Victorian Consolidated Regulations(1) In a proceeding commenced by writ or a proceeding in respect of which an order has been made under Rule 4.07(1) a defendant may not file a third party notice until the defendant has first served a defence.
(2) A defendant may file a third party notice—
(a) within 30 days after the time limited for the service of a defence; or
(b) at any time with the leave of the Court or the consent in writing of the plaintiff and any other party who has appeared.
