Victorian Consolidated Regulations Victorian Consolidated Regulations(1) On an application under Rule 23.01 evidence is admissible for any party by affidavit or, if the Court thinks fit, orally.
(2) On an application under Rule 23.02 no evidence is admissible on the question whether a claim or pleading offends against that Rule.
(3) Rule 22.07 or Rule 22.21, as the case requires, applies to an affidavit under paragraph (1).
