(1) An employer or a self-employed person who would, apart from the operation of this Division, be required on 15 November 2021 to hold an engineered stone licence under regulation 319Z, must apply for a licence on that day or as soon as reasonably practicable after that day.
(2) During the transition period, if an employer or a self-employed person becomes a person required to hold an engineered stone licence under regulation 319Z , that person must apply for a licence within 14 days after an engineered stone process is commenced at the workplace.
(3) If an employer or a self-employed person has applied for an engineered stone licence and, at the end of the transition period, the Authority has not made a decision to grant or refuse to grant a licence, the employer or self-employed person is exempt from the requirement to hold a licence under regulation 319Z until—
(a) the Authority grants the licence; or
(b) the Authority refuses to grant the licence.
(4) If an employer or a self-employed person applies for an engineered stone licence before the end of the transition period and the Authority decides to grant the licence, the Authority must specify a date on which the licence comes into force that is on or after the end of the transition period.
