ROAD SAFETY (DRIVERS) REGULATIONS 2019 - REG 61

Peer passenger restriction for P1 probationary drivers

    (1)     A P1 probationary driver or corresponding novice driver must not drive a motor vehicle on a highway in which there is more than one peer passenger.

Penalty:     10 penalty units.

    (2)     Subregulation (1) does not apply to a driver—

        (a)     who is a police officer and is driving a police vehicle in the course of the driver's duties; or

        (b)     who is driving an emergency vehicle on a highway in the course of the driver's employment or duties, or in accordance with any terms of a contract or any engagement; or

        (c)     who is driving a motor vehicle on a highway in which there is a person who—

              (i)     at the relevant time holds a full driver licence that authorises the person to drive that vehicle; and

              (ii)     is sitting beside the driver and is supervising the driver; or

        (d)     who has been exempted from the requirement in subregulation (1) by the Secretary in accordance with regulation 101.
