(1) The Marshal may obtain indemnity insurance for all or part of the period during which a ship or other property is in the custody or possession of the Marshal and the cost of such insurance shall be an expense incurred by the Marshal in relation to the arrest payable by the party issuing the writ for the arrest of the ship.
(2) The Court may require that a party pay the
cost of the insurance referred to in paragraph (1) at the time the writ is
issued.
