SUPREME COURT (CORPORATIONS) RULES 2013 - REG 5.9

Appearance before Associate Judge or judicial registrar

After filing an originating process seeking an order that a company be wound up, the plaintiff must, if required—

Rule 5.9(a) amended by S.R. No. 10/2015 rule 16.

        (a)     appear before an Associate Judge or a judicial registrar on a date to be appointed by the Associate Judge or the judicial registrar, as the case requires; and

Rule 5.9(b) amended by S.R. No. 10/2015 rule 16(b).

        (b)     satisfy the Associate Judge or the judicial registrar, as the case requires that the plaintiff has complied with the Corporations Act and these Rules in relation to applications for a winding up order.
