ACCIDENT COMPENSATION AMENDMENT ACT 2010 (NO. 9 OF 2010) - SECT 184

Information and records to be supplied by insurers [section 39]

For section 39(4) of the Accident Compensation (WorkCover Insurance) Act 1993 substitute —

    "(4)     An insurer must comply with a requirement under this section in the manner and within the time specified by the requirement.

Penalty:     In the case of a natural person, 100 penalty units;

In the case of a body corporate, 500 penalty units.

    (4A)     It is a defence to a charge of an offence against subsection (4) for the defendant to prove that it was not within the power of the defendant to comply with the requirement.".
