AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 (NO. 21 OF 2012) - SECT 215

Findings in proceedings to be evidence

    (1)     In a proceeding against a person under section 216 or 217 of this Act, a finding of fact by a court made in proceedings under section 201, 202, 203, 205, 206, 210 or 211 in which that person has been found to have contravened, or to have been involved in a contravention of, a provision of this Act (other than the Australian Consumer Law (Victoria)) is evidence of that fact and the finding may be proved by production of a document under the seal of the court from which the finding appears.

    (2)     In a proceeding against a person under section 236, 237, 238 or 239 of the Australian Consumer Law (Victoria), a finding of fact by a court made in proceedings under section 228, 232, 233, 234, 237, 246, 247 or 248 or any provision of Chapter 4 of that Law in which that person has been found to have contravened, or to have been involved in a contravention of, the Australian Consumer Law (Victoria) is evidence of that fact and the finding may be proved by production of a document under the seal of the court from which the finding appears.
