CATCHMENT AND LAND PROTECTION AMENDMENT ACT 2013 (NO. 51 OF 2013) - SECT 16

After section 80 of the Principal Act insert —

    " 80A     Entry of roadsides

    (1)     For the purposes of monitoring a municipal council's implementation of its approved roadside weed and pest animal management plan, or in order to evaluate a municipal council's report on its approved plan under section 22Q, an authorised officer may enter the roadside of any municipal road to which the plan applies and may do all or any of the following—

        (a)     search and examine the roadside;

        (b)         take photographs (including video recordings) of a thing or things of a particular kind on the roadside;

        (c)     without payment, take samples of any of the following on the roadside—

              (i)     plants or parts of plants;

              (ii)     an animal or part of an animal;

              (iii)     soil, sand, gravel or stone.

    (2)     Section 83K does not apply in respect of a sample taken by an authorised officer under subsection (1).".
