DISABILITY SERVICE SAFEGUARDS ACT 2018 (NO. 38 OF 2018) - SECT 203

Removal of condition or revocation of undertaking

    (1)     Subject to subsections (2) and (3), the Board may decide to remove a condition on a registration or revoke an undertaking given by a registered disability worker or disability student if the Board reasonably believes that—

        (a)     the condition imposed on the registration is no longer necessary; or

        (b)     the undertaking given to the Board is no longer necessary.

    (2)     The Board must not remove a condition under subsection (1) during a review period unless the Board reasonably believes there has been a material change in the disability worker's or disability student's circumstances.

    (3)     As soon as practicable after making the decision, the Board must give notice of the decision to the registered disability worker or disability student.

    (4)     A decision to remove a condition or revoke an undertaking takes effect on the date stated in the notice.
