FINES REFORM ACT 2014 (NO. 47 OF 2014) - SECT 211

Person may elect to have matter heard in Court or Children's Court

    (1)     For section 16(1) of the Infringements Act 2006 substitute

    "(1)     Unless subsection (1A) applies, a person served with an infringement notice may elect to have the matter of the infringement offence heard and determined in the Court at any time before the outstanding amount of the infringement penalty, together with any prescribed costs are registered with the Director under the Fines Reform Act 2014 .

    (1A)     A person served with an infringement notice in respect of a non-registrable infringement offence may elect to have the matter of the infringement offence heard and determined in the Court at any time before the expiry of the period for commencing a proceeding in relation to the offence to which the infringement notice relates.".

    (2)     In section 16(3) of the Infringements Act 2006

        (a)     for "subsection (1)" substitute "subsections (1) and (1A)";

        (b)     for "bringing" substitute "commencing".
