MITCHAM-FRANKSTON PROJECT ACT 2004 (NO 39 OF 2004) - SECT 260

In Part 2 of Schedule 7 to the Magistrates' Court Act 1989 , for " section 87(3)(a) of that Act." in clause 4(2)(j) substitute —

"section 87(3)(a) of that Act; and

        (k)     if the infringement notice was issued in respect of an offence under section 204 of the Mitcham-Frankston Project Act 2004 , the person was at the time of the trip to which the alleged offence relates—

              (i)     the owner of the vehicle within the meaning of that Act; or

              (ii)     the driver of the vehicle as shown in a statement supplied under section 199 or 219 of that Act.".
