Victorian Numbered Acts Victorian Numbered Acts(1) An inspector may give a direction (either orally or in writing) to a person at a workplace if the inspector reasonably believes that it is necessary to do so because of an immediate risk to the health or safety of any person.
(2) A person must not, without reasonable excuse, refuse or fail to comply with a direction given to the person under sub-section (1).
Penalty: 500 penalty units for a natural person;
2500 penalty units for a body corporate.
(3) An offence against sub-section (2) is an indictable offence.
Note: However, the offence may be heard and determined summarily (see section 53 of, and Schedule 4 to, the Magistrates' Court Act 1989 ).
