RAIL SAFETY ACT 2006 (NO 9 OF 2006) - SECT 57

False or misleading information

    (1)     A person must not in, or in relation to an application for—

        (a)     an accreditation; or

        (b)     a variation of accreditation; or

        (c)     a variation of a condition or restriction of an accreditation

give information that is false or misleading in a material detail.

Penalty:     In the case of a natural person, 60 penalty units or 6 months imprisonment or both;

In the case of a body corporate, 300 penalty units.

    (2)     In a proceeding for an offence against sub-section (1), it is a defence to the charge for the accused to prove that at the time at which the offence is alleged to have been committed, the accused believed on reasonable grounds—

        (a)     in the case of false information—that the information was true; or

        (b)     in the case of misleading information—that the information was not misleading.
