FISHERIES REGULATIONS 2009 (SR NO 2 OF 2009) - REG 373

Activities authorised by a Giant Crab Fishery (Western Zone) Access Licence

    (1)     A Giant Crab Fishery (Western Zone) Access Licence authorises the licence holder to use the boat specified in the licence to carry out the following activities in the waters of the western rock lobster zone—

        (a)     the use of the same number of rock lobster pots authorised to be used by the Rock Lobster Fishery (Western Zone) Access Licence held by the licence holder that is specified in the licence (other than in waters that are part of a marine national park or a marine sanctuary);

        (b)     the possession of the same number of rock lobster pots authorised to be possessed by the Rock Lobster Fishery (Western Zone) Access Licence held by the licence holder;

        (c)     the taking for sale of giant crab;

        (d)     the engagement of one or more persons to carry out any activity authorised by the licence.

    (2)     In addition to the number of rock lobster pots authorised to be used under subregulation (1)(a), a licence holder who is allocated 60 or more quota units in respect of the giant crab fishery may use a number of additional rock lobster pots determined by the Secretary and specified in the licence for the purpose of catching giant crab.

    (3)     For the purposes of subregulation (2), the Secretary may determine that a licence holder may use an additional number of rock lobster pots     .

    (4)     A determination made by the Secretary under subregulation (3) must not be inconsistent with any relevant fisheries management plan.
