ROAD SAFETY (DRIVERS) (DEMERIT POINTS CANCELLATION) REGULATIONS 2004 (SR NO 55 OF 2004) - REG 3

After regulation 302A(2) of the Road Safety (Drivers) Regulations 1999 ^[1] insert —

    "(2A)     If—

        (a)     the Corporation has served a notice on a person under section 25(3) of the Act and the person has elected, in accordance with section 25(3A) of the Act, to extend the demerit point period; and

        (b)     as a result of the person incurring 1 or more additional demerit points in the circumstances set out in section 25(3B) of the Act, the Corporation has suspended the driver licence or permit of the person in accordance with section 25(3B); and

        (c)     1 or more of the additional demerit points referred to in paragraph (b) is cancelled in accordance with sub-regulation (1)—

the Corporation must cancel all demerit points recorded against the person as at the date of issue of the notice under section 25(3).".
