SUPREME COURT (GENERAL CIVIL PROCEDURE) RULES 2015 (SR NO 103 OF 2015) - REG 10.08
Counterclaim on stay etc., of original proceeding
A counterclaim may be prosecuted notwithstanding—
(a) that judgment is given for the
plaintiff in the original proceeding; or
(b) that the original proceeding is
stayed, discontinued or dismissed.
