TRANSPORT (PASSENGER VEHICLES) REGULATIONS 2005 (SR NO 66 OF 2005) - REG 40

Driver's ticketing obligations

    (1)     A driver of a public commercial passenger vehicle or a public passenger vehicle operated for the purpose of a regular passenger service must, unless there is a reasonable excuse, take the following steps when a passenger boards the vehicle—

        (a)     if the passenger does not already hold a ticket, request that the passenger pay the correct fare for the journey the passenger is about to take and when sufficient money is given to the driver, issue the correct ticket to the passenger for the journey;

        (b)     if the passenger relies on an existing ticket which requires machine validation after purchase and which, if validated, would be valid for the journey the passenger is about to take

              (i)     request that the passenger validate the ticket using the ticket validating machine on the vehicle;

              (ii)     if there is no ticket validating machine on the vehicle or if the machine is not operational, request that the passenger show the ticket to the driver;

        (c)     if a passenger pays for a ticket but does not take or accept it, immediately rip the ticket in half, leave it in the tray beside the driver that is used for the exchange of cash, tickets and other items between the driver and passengers until the passenger leaves the vehicle or the journey ends.

Penalty:     5 penalty units.

    (2)     Sub-regulations (1)(a) and (1)(b) do not apply if the relevant passenger has already taken the action which is otherwise to be the subject of a request by the driver.
