Terms and conditions of office205. Terms and conditions of office (1) A member of the Youth Residential Board appointed by the Governor in Council holds office for the term, not exceeding 3 years, that is specified in the instrument of appointment, and is eligible for re-appointment. (2) A member appointed by the Governor in Council may resign his or her office in writing delivered to the Governor in Council. (3) The Governor in Council may remove from office a member appointed by the Governor in Council. (4) A member is entitled to be paid- (a) any remuneration that is fixed by the Governor in Council; and (b) any travelling and other allowances that are fixed by the Governor in Council. (5) A member is appointed subject to any other terms and conditions that are specified in the instrument of appointment and that are not inconsistent with this Act. (6) If a member who is a judge of the County Court ceases to be such a judge, he or she ceases to hold office as a member. (7) The Public Administration Act 2004 (other than Part 3 of that Act) applies to a member in respect of the office of member. (8) The appointment of a judge of the County Court as a member does not affect the tenure of office, rank, status, remuneration, rights or privileges of that person as a judge and, for all purposes, service as a member of the Youth Residential Board by a judge is to be regarded as service as a judge. (9) If a person was immediately before becoming a member of the Youth Residential Board an officer within the meaning of the State Superannuation Act 1988, the member continues, subject to that Act, to be an officer within the meaning of that Act.
