Probation officers34. Probation officers (1) The Secretary- (a) has the duty of generally supervising all probation work under this Act; and (b) has the powers and duties prescribed by or under this Act. (2) There are to be employed under Part 3 of the Public Administration Act 2004 as many stipendiary probation officers for the Court as are necessary. (3) A probation officer appointed under sub-section (2) has the powers and duties prescribed by or under this Act. (4) The Secretary may, by instrument published in the Government Gazette, appoint as an honorary probation officer any fit and proper person who is willing to exercise and perform the powers and duties given to honorary probation officers by or under this Act. (5) An honorary probation officer is not in respect of the office of honorary probation officer subject to the Public Administration Act 2004. (6) A probation officer is, in relation to a probation order, subject to the direction of the Court but otherwise he or she is subject to the direction and control of the Secretary. (7) The Secretary must co-ordinate the activities of probation officers.
