Farm Water Supplies Advances Act 1944 - SECT 8

Offences

8. Offences



(1) Any person-

   (a)  who commits any fraudulent act with respect to any advance under this
        Act or who knowingly and fraudulently aids or abets any other person
        in any such act; or

   (b)  who wilfully makes any false statement in any application or other
        writing made under or for the purposes of this Act-

shall, without prejudice to proceedings for any other offence for which he may
be liable, be guilty of an indictable offence and liable to a penalty of not
more than One hundred pounds or to imprisonment for a term of not more than
two years.

(2) Any person-

   (a)  who receives any advance from the Board under this Act and in any
        manner directly or indirectly uses the same or permits the same to be
        used for any purpose other than the purpose for which the advance was
        made; or

   (b)  who, while any money is owing to the Board in respect of any advance
        under this Act, without the consent of the Board removes sells or
        otherwise disposes of any machinery plant or other thing forming part
        of any works for the construction of which such advance was made-

shall be guilty of an offence against this Act and shall be liable to a
penalty of not more than Twenty pounds or to imprisonment for a term of not
more than six months.
