Meaning of management role and substantial interest63H. Meaning of management role and substantial interest (1) For the purposes of sections 63A to 63G a person is to be treated as having a management role or substantial interest in a body corporate if- (a) the person is a director, secretary or executive officer of the body corporate; or (b) in the case of a body corporate that is incorporated as a corporation limited by shares, the person is entitled to more than 10% of the issued share capital of the corporation (with the shares to which a person is entitled including shares in which the person or an associate of the person has a relevant interest within the meaning of the Corporations Act). (2) For the purposes of sections 63A to 63G a person is to be treated as having a substantial interest in a trust if the person (whether or not as the trustee of another trust) is the beneficiary in respect of more than 10% of the value of the interests in the trust.
