The Parliament of Western Australia enacts as follows: page 1 Criminal Procedure Amendment (Trial by Judge Alone) Bill 2017 s. 1 1 1. Short title 2 This is the Criminal Procedure Amendment (Trial by Judge 3 Alone) Act 2017. 4 2. Commencement 5 This Act comes into operation as follows -- 6 (a) sections 1 and 2 -- on the day on which this Act 7 receives the Royal Assent; 8 (b) the rest of the Act -- on a day fixed by proclamation. 9 3. Act amended 10 This Act amends the Criminal Procedure Act 2004. 11 4. Section 118 amended 12 Delete section 118(4), (5) and (6) and insert: 13 14 (4) Except as provided in subsections (5), (7) and (8), the 15 court must make the order unless the court is satisfied 16 that the order is not in the interests of justice. 17 (5) If the application is made by the prosecutor, the court 18 must not make the order without the consent of the 19 accused. 20 21
