    Food Amendment (Shark Fin Prohibition)
                 Bill 2019

                               A Bill for


An Act to amend the Food Act 2008 to prohibit the sale and supply of
shark fin products and for incidental and related purposes.



The Parliament of Western Australia enacts as follows:

1    1.       Short title
2             This is the Food Amendment (Shark Fin Prohibition) Act 2019.

3    2.       Commencement
4             This Act comes into operation as follows --
5              (a) sections 1 and 2 -- on the day on which this Act
6                    receives the Royal Assent;
7              (b) the rest of the Act -- on a day fixed by proclamation.

8    3.       Act amended
9             This Act amends the Food Act 2008.

10   4.       Section 22A inserted
11            After section 22 insert:

12          22A.    Food containing shark fins
13            (1)   In this section --
14                  shark fin means any fin of any shark that is not
15                  attached to the fish trunk as defined in the Fish
16                  Resources Management Regulations 1995, and
17                  includes cartilaginous dorsal, pectoral and caudal fins
18                  and the tail.
19            (2)   A person must not sell food that the person knows
20                  contains shark fin.
21                  Penalty:
22                      (a) for an individual -- a fine of $50 000;
23                      (b) for a body corporate -- a fine of $250 000.

1   (3)   A person must not sell food that the person ought
2         reasonably to know contains shark fin.
3         Penalty:
4             (a) for an individual -- a fine of $40 000;
5             (b) for a body corporate -- a fine of $200 000.
