A Bill for
An Act to amend the Hope Valley-Wattleup Redevelopment Act 2000.
The Parliament of Western Australia enacts as follows:

1 1. Short title
2 This is the Hope Valley-Wattleup Redevelopment Amendment
3 Act 2010.
4 2. Commencement
5 This Act comes into operation as follows --
6 (a) sections 1 and 2 -- on the day on which this Act
7 receives the Royal Assent;
8 (b) the rest of the Act -- on the day after that day.
9 3. Act amended
10 This Act amends the Hope Valley-Wattleup Redevelopment
11 Act 2000.
12 4. Section 2 deleted
13 Delete section 2.
14 5. Section 3 amended
15 (1) In section 3(1) delete the definition of FRIARS Final Strategy
16 document.
17 (2) Delete section 3(2).
18 6. Section 10 amended
19 Delete section 10(1) and insert:

21 (1) The Authority must perform its functions under this
22 Act in accordance with any master plan.

2 (1) In section 11 delete "A master" and insert:

6 (2) At the end of section 11 insert:

8 (2) A master plan must not be inconsistent with any
9 regulations made under this Act.
10 (3) If a provision in a master plan is inconsistent with
11 regulations made under this Act, the provision is void
12 to the extent of the inconsistency.

15 At the end of Part 3 insert:

17 Division 5 -- Effect of master plan
18 22A. Master plan's effect
19 (1) A master plan has legislative effect.
20 (2) To avoid doubt, a master plan is, for all purposes
21 including those of the Interpretation Act 1984,
22 subsidiary legislation made under this Act.
23 (3) The Interpretation Act 1984 section 41 does not apply
24 to a master plan.
25 22B. Contravening a master plan
26 A person must not contravene a master plan.
27 Penalty: $50 000, and a daily penalty of $5 000.

9 Amendment Act 2010
10 (1) In this section --
11 commencement day means the day on which the Hope
12 Valley-Wattleup Redevelopment Amendment Act 2010,
13 other than sections 1 and 2 of it, comes into operation.
14 (2) If a master plan came into operation before the
15 commencement day, it is taken to have had legislative
16 effect from and including the day it came into
17 operation until but not including the commencement
18 day.
19 (3) An act done or omission made pursuant to a master
20 plan before the commencement day has, and is taken to
21 always have had, the same validity as it would have
22 had if subsection (2) had been in operation at the time
23 of the act or omission.
