Murray, MLA) Liquor Control Amendment Bill 2013 A Bill for An Act to amend the Liquor Control Act 1988 to restrict the provision of alcohol to juveniles on unlicensed premises. The Parliament of Western Australia enacts as follows: page 1 Liquor Control Amendment Bill 2013 s. 1 1 1. Short title 2 This is the Liquor Control Amendment Act 2013. 3 2. Commencement 4 This Act comes into operation as follows -- 5 (a) sections 1 and 2 -- on the day on which this Act 6 receives the Royal Assent; 7 (b) the rest of the Act -- on a day fixed by proclamation, 8 and different days may be fixed for different provisions. 9 3. Act amended 10 This Act amends the Liquor Control Act 1988. 11 4. Section 119AA inserted 12 At the end of Part 4 Division 8 insert: 13 119AA. Juveniles on unlicensed premises 14 (1) In this section -- 15 parent or guardian, of a juvenile, means an adult who 16 is a parent, step-parent, spouse, de facto partner or legal 17 guardian of the juvenile or is otherwise in loco parentis 18 to the juvenile; 19 unlicensed premises means any place other than 20 licensed or regulated premises and includes residential 21 premises. 22 (2) A person must not supply liquor to a juvenile on 23 unlicensed premises unless the person is a parent or 24 guardian of the juvenile. 25 Penalty: a fine of $4 000. 26 (3) It is a defence to a charge for an offence under 27 subsection (2) to prove that the accused was authorised page 2 Liquor Control Amendment Bill 2013 s. 4 1 to supply liquor to the juvenile by a parent or guardian 2 of the juvenile. 3 4
