A Bill for
An Act to amend the School Education Act 1999 and to make
consequential amendments to the School Curriculum and Standards
Authority Act 1997.
The Parliament of Western Australia enacts as follows:

1 Part 1 -- Preliminary
2 1. Short title
3 This is the School Education Amendment Act 2012.
4 2. Commencement
5 This Act comes into operation as follows --
6 (a) sections 1, 2, 3 and 5 -- on the day on which this Act
7 receives the Royal Assent;
8 (b) the rest of the Act -- on 1 January 2013.

3 This Part amends the School Education Act 1999.
4 4. Section 4 amended
5 (1) In section 4 delete the definition of year 11 and year 12.
6 (2) In section 4 insert in alphabetical order:

8 final years of compulsory education for a child means
9 the final 2 years of the compulsory education period for
10 the child;

12 (3) In section 4 in the definition of teaching staff delete
13 "section 236(2);" and insert:

15 section 236(2).

18 Delete sections 5 and 6 and insert:

20 5. Pre-compulsory education period
21 The pre-compulsory education period for a child is as
22 follows --
23 (a) until 31 December 2012 --
24 (i) from the beginning of the year in which
25 the child reaches the age of 4 years and
26 6 months; and

1 (ii) until the end of the year in which the
2 child reaches the age of 5 years and
3 6 months;
4 (b) from 1 January 2013 --
5 (i) from the beginning of the year in which
6 the child reaches the age of 4 years and
7 6 months; and
8 (ii) until the end of that year.
9 6. Compulsory education period
10 (1) The compulsory education period for a child is as
11 follows --
12 (a) until 31 December 2012 --
13 (i) from the beginning of the year in which
14 the child reaches the age of 6 years and
15 6 months; and
16 (ii) until the end of the year in which the
17 child reaches the age of 17;
18 (b) from 1 January 2013 until
19 31 December 2013 --
20 (i) from the beginning of the year in which
21 the child reaches the age of 5 years and
22 6 months; and
23 (ii) until the end of the year in which the
24 child reaches the age of 17;
25 (c) from 1 January 2014 --
26 (i) from the beginning of the year in which
27 the child reaches the age of 5 years and
28 6 months; and
29 (ii) until --
30 (I) the end of the year in which the
31 child reaches the age of
32 17 years and 6 months; or

1 (II) the child reaches the age of 18,
2 whichever happens first.
3 (2) If a child satisfies the minimum requirements for
4 graduation from secondary school established under
5 the School Curriculum and Standards Authority
6 Act 1997 before the end of the compulsory education
7 period under subsection (1), this Act applies in respect
8 of the child as if the compulsory education period for
9 the child ended when the requirements were satisfied.

11 6. Part 2 Division 1 heading replaced
12 Delete the heading to Part 2 Division 1 and insert:

14 Division 1 -- Compulsory education with alternatives in
15 final years of compulsory education
