An Act to prohibit the mining of uranium in Western Australia.
The Parliament of Western Australia enacts as follows:

3 This is the Uranium Mining Prohibition (Keeping WA free from
4 the Nuclear Fuel Chain) Act 2009.
5 2. Commencement
6 This Act comes into operation on the day on which this Act
7 receives the Royal Assent.

3 3. The Act amended
4 The amendments in this Act are to the Mining Act 1978.
5 4. Section 154A inserted
6 After section 154 the following section is inserted:

8 154A. Uranium mining prohibited
9 (1) A person who mines uranium commits an offence.
10 Penalty: $5,000,000 and if the offence is a continuing
11 one, to a further fine of $500,000 for every day or
12 part of a day during which the offence has
13 continued.
14 (2) It is a defence to a charge under this section to show
15 that the accused person mined the uranium incidentally
16 to the mining of other minerals and not for the purpose
17 of sale.
